Questions about the Streamlined Procedure

Will the IRS penalize me for filing late?

No. The Streamlined Procedure was designed exactly for non-willful late filers: all failure-to-file and failure-to-pay penalties are waived as long as the filing certifies the non-willful nature of the delay.

How many years back do I have to file?

Only the last 3 years of tax returns and the last 6 years of FBARs (foreign bank account reports). Not every year you missed.

Could I actually get a refund?

Often, yes. Child tax credits, the American Opportunity (university) credit, and any unclaimed stimulus payments are frequently recoverable through the Streamlined filing.

How long does the whole process take?

Typically 4–8 weeks from the day we receive all your documents. Complex cases with multiple income sources or trusts may take longer.

I haven't filed in over 10 years — am I still eligible?

Yes. Eligibility for the Streamlined Procedure is about whether the late filing was non-willful, not how long ago you stopped filing.

Will I be audited?

Streamlined applicants prepared by a licensed Enrolled Agent are very rarely audited. The IRS typically reviews the certification and 3 years of returns and closes the case without examination.
